1. Introduction

These Terms & Conditions govern your use of Zapify. By accessing our platform, you agree to follow all terms stated here.


2. Definitions

  • “User”, “You” = individuals or businesses using Zapify

  • “Service” = Zapify’s WhatsApp CRM & marketing platform

  • “Customer Data” = information you upload or process through Zapify

  • “WhatsApp API Provider” = official Meta-approved provider enabling WhatsApp Business API


3. Use of Services

You agree to use Zapify only for lawful business purposes and not to:

  • Send spam or unsolicited messages

  • Violate WhatsApp Business policies

  • Abuse or overload servers

  • Reverse-engineer or attempt unauthorized access

  • Distribute harmful content or malware


4. Account Responsibilities

Users must:

  • Provide accurate registration information

  • Keep login credentials secure

  • Maintain compliance with WhatsApp guidelines

  • Ensure all messages sent through Zapify follow local regulations

You are responsible for all actions taken under your account.


5. Subscription, Billing & Payments

  • Services are billed on a subscription basis

  • Fees are non-refundable unless stated in Refund Policy

  • You authorize recurring charges to your payment method

  • Failure to pay may result in account suspension

6. Message Delivery & Service Reliability

Zapify uses official WhatsApp providers but cannot guarantee delivery due to:

  • WhatsApp network interruptions

  • Customer device issues

  • API rate limits

  • Carrier restrictions


7. Ownership of Content

You retain ownership of all Customer Data.
Zapify retains ownership of:

  • Platform code

  • Designs & branding

  • Documentation & materials


8. Termination

Zapify may suspend or terminate access for:

  • Policy violations

  • Non-payment

  • Illegal activity

  • Abuse or spam complaints

Users may cancel at any time.


9. Limitation of Liability

Zapify is not liable for:

  • Loss of profits

  • Business interruptions

  • Loss of customer data

  • API outages or WhatsApp restrictions

Maximum liability is limited to the value of 1 month of subscription fees.


10. Governing Law

These terms are governed by the laws of Kenya.
